1. Acceptance

These Terms of Use (the “Terms”) govern your access to and use of miamihousemarket.eu (the “Site”), operated by Viru Group OÜ, a company within the Viru Group portfolio. By accessing the Site, submitting an enquiry, subscribing to our newsletter, or otherwise interacting with our service, you agree to be bound by these Terms. If you do not agree, please stop using the Site.

2. Nature of the service

Miami House Market is an editorial lead-generation platform. We publish information about new-construction residential inventory in Miami-Dade County, Florida, and we introduce qualified buyers to builders and brokers licensed in the State of Florida.

We are not a licensed real-estate brokerage in any jurisdiction. Our role is editorial and relational; the actual transaction is conducted between you, your chosen legal/tax advisors, and a Florida-licensed broker, builder, or title agent. Any closing or transaction-level service is provided by those independent licensed parties, not by us.

3. No professional advice

Nothing on the Site constitutes legal, tax, immigration, investment, mortgage, accounting, or real-estate brokerage advice. Editorial content, including the Cashflow Home model, EB-5 guidance, property-tax explainers, neighborhood theses, and project profiles, is provided for general informational and orientation purposes only.

Before making any property, investment, immigration, or financial decision, you must consult an appropriately qualified and licensed professional in your own jurisdiction (and in Florida where the transaction occurs). Past performance of the Miami market does not predict future returns.

4. Inventory data

We work to keep project pricing, delivery dates, floor plans, and availability current, but inventory in the Miami new-construction market moves daily. All published figures are subject to confirmation by the developer or their authorised broker at the moment of contract. Pricing, availability, and any incentives may change without notice and may differ from what appears on the Site.

5. Intellectual property

All editorial content on the Site, including but not limited to text, articles, neighborhood theses, the Cashflow Home model, illustrations, the Pastel Oasis design system, the “Miami House Market” name and logo, is owned by Viru Group OÜ or licensed to us, and protected by copyright, trademark, and database-rights law.

You may view and quote short excerpts for personal, non-commercial reference with clear attribution and a link back to the source page. Any other use, including commercial republication, training of AI models on the corpus beyond what robots.txt and /llms.txt permit, scraping for resale, or sub-licensing, requires our prior written consent.

Builder names, project names, and architectural renderings remain the intellectual property of their respective owners and are used here for editorial reference under fair-use / fair-dealing principles.

6. Third-party links and content

The Site links to third-party sites, builder corporate pages, the Florida Department of Business and Professional Regulation (DBPR), Brightline rail timetables, official municipal sources, and others. We do not control these sites, do not endorse their content, and are not responsible for their availability, accuracy, or any consequences of following the link.

7. Acceptable use

You agree not to:

  • Submit false, misleading, or impersonated information in our lead forms.
  • Use the Site to send unsolicited commercial communication (“spam”).
  • Scrape, crawl, or harvest content for resale, training datasets, or competing services beyond what our robots.txt and /llms.txt explicitly permit.
  • Attempt to compromise the security or availability of the Site, including via injection, brute-force, denial-of-service, or related techniques.
  • Reverse-engineer, decompile, or otherwise attempt to derive source code for any client-side or server-side component.
  • Use the Site to facilitate unlawful activity in any jurisdiction.

8. Disclaimers and limitation of liability

The Site and its content are provided “as is” and “as available”, without any express or implied warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, currency, completeness, or non-infringement.

To the maximum extent permitted by law, Viru Group OÜ and its affiliates, officers, employees, contributors, and licensors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of, or inability to use, the Site or any content on it, including lost profits, lost opportunity, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded as a matter of mandatory law, our aggregate liability to you for any cause of action arising out of or related to the Site is limited to one hundred euros (EUR 100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for fraud, fraudulent misrepresentation, death, or personal injury caused by our negligence).

9. Indemnity

You agree to indemnify and hold harmless Viru Group OÜ, its affiliates, and its personnel from any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of your breach of these Terms or your unlawful or harmful use of the Site.

10. Changes to these Terms

We may revise these Terms from time to time. The latest version always lives at this URL with the “Last updated” date at the top. Material changes will be flagged prominently on the home page or via newsletter for at least 14 days before they take effect. Continued use of the Site after the effective date constitutes acceptance.

11. Governing law and venue

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be submitted to the exclusive jurisdiction of the Harju County Court (Harju Maakohus), Tallinn, Estonia. For consumer users resident in the European Economic Area, this does not override mandatory consumer-protection rights in your country of residence.

12. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and the cookie consent banner, constitute the entire agreement between you and Viru Group OÜ regarding the Site and supersede any prior agreement on the same subject.
